Judicial Panel to Reexamine Ruling That Permitted Trump to Send Military Forces to Oregon City

Judicial Panel Concurs to Reconsider Case

The federal appeals court decided on Tuesday that it would rehear the case concerning the executive power with an expanded panel of 11 judges. The judicial body also vacated a previous ruling from a smaller judicial group that had supported the administration.

Legal Saga Over Troop Deployment

This order represents the latest turn in a long-running court case over whether the administration has the authority and valid reason to deploy national guard forces in Portland. Approximately 200 federalized guard members have been in limbo since late September when the mobilization attempt was initiated in response to ongoing demonstrations.

Differing Viewpoints

The administration has claimed that federal officials at the immigration center in south Portland were facing threats, while local authorities assert that municipal police have command of the circumstances.

Contrary to descriptions of the city as “war ravaged”, residents have been sharing footage of scenic paths and a thriving food scene, and organizing activities such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The appeals court decision came after a federal judge in the city issued two temporary restraining orders this month – one preventing the federal control of the state troops, and another prohibiting the deployment of any military personnel in the state, after attempts to evade the first order by calling up out-of-state forces.

On Monday, the ninth circuit panel had temporarily suspended the initial decision – allowing control of state troops – but the subsequent injunction remained in place, preventing the actual deployment of the forces.

Full Panel Consideration

The Tuesday decision means the matter will be heard by the full court – with all decisions under review together – by a group of eleven justices.

“This ruling demonstrates that the truth matters and that the judicial system are working to hold this administration accountable. The constitution limits the executive authority, and local populations cannot be treated as a training ground for expansive government power,” stated the state attorney general in a statement.

“The judicial body is sending a definite signal: the president cannot send the military into US cities without cause. We will continue defending state legislation, values, and autonomy as this case progresses and our legal battle continues in the courts.”
